1. Agreement to These Terms

By using our website or services, you agree to these Terms. You must have the legal authority to enter into this agreement. If you are a business user acting on behalf of a company, brokerage, or agency, you represent that you have the authority to bind that entity to these Terms. If you do not agree, you should not use our services.

2. Our Services

GetPik may provide property visual production services such as:

• Real estate photo editing and HDR image enhancement
• Virtual staging and day-to-dusk editing
• Item and object removal
• Interior and exterior photo enhancement
• Floor plan redraws and 3D floor plans
• 3D real estate rendering and custom property visual editing

Please note that our available services may vary over time. Pricing, scope, turnaround times, and deliverables will depend on the specific requirements of your project. We do not guarantee that every service listed is always available.

3. Quotes, Orders and Project Acceptance

Any quote provided by GetPik is based solely on the information and instructions supplied by the client. If the files or requirements present additional complexity upon review, a revised quote may be required. Submission of files does not mean automatic acceptance of a project. GetPik reserves the right to decline projects that are outside our scope, technically unsuitable, unlawful, or otherwise inappropriate. Custom work may require separate written approval before production begins.

5. Portfolio and Marketing Use

GetPik respects the confidentiality of your listings. We will not publicly use client property images, before/after examples, logos, or project materials for marketing or portfolio purposes without permission where permission is required.

6. Client Responsibilities

As a client using our services, you agree to:

• Provide accurate, clear project instructions.
• Supply appropriate source files suitable for editing.
• Confirm that all uploaded content is lawful and does not violate privacy or intellectual property rights.
• Review proofs and deliverables promptly.
• Provide complete, consolidated revision instructions.
• Not upload malicious files or attempt to compromise our systems.

7. Real Estate Image Accuracy and Disclosure

GetPik provides image enhancement and visualization services. Some services, such as virtual staging, item removal, sky replacement, day-to-dusk editing, and 3D visualization, may materially alter the visual appearance of a property.

Clients are solely responsible for complying with Multiple Listing Service (MLS) rules, advertising regulations, disclosure requirements, local real estate laws, and their own brokerage policies. GetPik does not determine whether a specific edited image can legally or ethically be used in a particular MLS, advertising platform, or jurisdiction.

8. Virtual Staging and Visualizations

Virtual staging is a digital visual representation. Furniture, décor, or structural elements shown digitally may not physically exist at the property. Renderings or 3D visuals may be strictly conceptual. Clients should use appropriate visual disclosures (e.g., "Virtually Staged") when required by their local market regulations. GetPik does not guarantee that staged or rendered elements will precisely match future physical construction or real-world furnishings.

9. Floor Plans and Measurements

Floor plans are prepared strictly from information, sketches, or measurements supplied by the client. GetPik does not independently survey, visit, or verify property measurements unless explicitly agreed in writing. Plans should be treated as illustrative marketing material. Clients must independently verify measurements before relying on them for construction, legal, valuation, or engineering purposes.

10. Turnaround Times

Any turnaround time displayed on our website or provided in a quotation is an estimate unless GetPik explicitly agrees to a guaranteed deadline in writing. Turnaround times can depend heavily on project volume, editing complexity, source file quality, requested revisions, and client response times.

11. Revisions

Revisions are intended to correct or adjust work based strictly on your original brief. Material changes to the scope of work after delivery may be treated as a new or additional project. Revision eligibility may depend on the service type purchased. We request that clients provide clear, consolidated feedback. GetPik reserves the right to charge additional fees for substantial changes that fall outside the original instructions.

12. Pricing and Payment

Prices displayed on the website may be standard or starting rates. The final price may depend on the complexity and scope of your specific files. Custom projects may require a bespoke quote. Applicable taxes or fees may be added where required by law. USD is our default pricing currency. Any currency conversions displayed on the website may be approximate. Payment terms will follow the invoice, quotation, or checkout instructions provided to you.

13. Cancellations and Refunds

Cancellation and refund eligibility depends on the stage of the project, the nature of the service, and any work already completed by our team. Work already completed or in progress may be non-refundable. Custom or partially completed work may be charged proportionally to the effort expended. Duplicate payments or billing errors should be reported immediately to our support team.

14. Delivery and File Availability

Finished files may be delivered through a client portal, secure download link, email, or another agreed digital method. Clients are entirely responsible for downloading and securely backing up final files upon delivery. GetPik does not guarantee indefinite retention of files and project files may be deleted from our servers after a reasonable retention period to ensure data hygiene.

15. Client Accounts and Portal Access

Where applicable, users are responsible for keeping client portal login credentials secure. You should not share credentials outside your authorized team members. Clients are responsible for all activity conducted under their account. GetPik reserves the right to suspend account access if misuse, unauthorized sharing, or a security risk is detected.

16. GetPik Intellectual Property

While you own your submitted files, the website design, GetPik branding, logos, website content, software, user interfaces, and service materials remain the exclusive property of GetPik or are licensed to GetPik. You may not copy, reproduce, or exploit our intellectual property without our express written consent.

17. Prohibited Use

Users may not:

• Use the website unlawfully or for fraudulent purposes.
• Upload malware or malicious code.
• Attempt unauthorized access to our systems or other clients' accounts.
• Abuse, harass, or threaten our staff.
• Submit content they do not have the legal rights to use.
• Scrape or systematically copy protected website material unlawfully.

18. Third-Party Services

GetPik may use third-party services for cloud hosting, storage, payment processing, email, analytics, communication, and file delivery. GetPik is not responsible for third-party outages, data breaches at third-party processors, or terms of service changes beyond our reasonable control.

19. Service Availability

Our website and services may occasionally be unavailable due to routine maintenance, technical issues, or server upgrades. GetPik reserves the right to modify or discontinue specific features or services at any time. We do not guarantee uninterrupted uptime unless explicitly backed by a separate Service Level Agreement (SLA).

20. Disclaimer of Warranties

Services are provided based on the agreed visual scope. GetPik does not guarantee business results. We do not guarantee a property sale, listing performance, buyer interest, search ranking, or MLS acceptance as a result of our visual editing services. Visual outcomes depend significantly on the quality and resolution of the source files provided by the client.

21. Limitation of Liability

To the maximum extent permitted by applicable law, GetPik will not be liable for indirect, incidental, special, or consequential losses, including loss of profits, data, use, goodwill, or other intangible losses arising from your use of the website or our services, or resulting from your inability to access the services.

22. Indemnification

You agree to indemnify and hold harmless GetPik, its employees, contractors, and affiliates from any claims, damages, liabilities, or expenses (including legal fees) arising from: content you submit without appropriate rights; unlawful use or misrepresentation of edited images; or your violation of these Terms of Service.

23. Governing Law

These Terms will be governed by the laws applicable to GetPik's legal business entity, subject to any mandatory consumer protection rights available to users under applicable law.
